The performance of this agreement is subject to termination without liability upon the occurrence of any circumstance beyond the control of either party such as acts of god, war, government regulations, disasters, civil disorder, strikes (except those involving the employees or agents of the parties seeking protection of this clause) or curtailment of transportation facilities – to the extent that such circumstances make it illegal or impossible to provide or use the Hotel’s facilities. The ability to terminate this agreement without liability pursuant of this paragraph is conditional upon delivery of written notice to the other party setting forth the basis for such termination as soon as reasonably practical; but no later than ten 10 days after learning of such basis.
Cancellations
Once an event is cancelled/date changed by the event booker, the hotel loses the business opportunity for the said day on account of refusing other guest enquiries by the hotel. In view of the above, any refund of non-refundable advance shall be governed by the cancellation refunds table below, in the unlikely event of cancellation and advance refunds. REFUNDS: Date Change/Cancellation for Banquets / Events/ Rooms A 0 - 45 days Nil B 46 - 90 days 25% C 91 - 120 days 50% D 121 Days & Above 75% Note: • All cancellations must be notified in writing. • The organizer, who made the bookings, will be responsible for the late cancellation, no show charges and early departure charges of guests. • On cancellation of the event all amounts received by the Hotel towards the Event will be forfeited by the Hotel. Should the deposits received be insufficient to meet the cancellation fee amount, the Client is liable to pay to Hotel the balance due within 7 days of cancellation.
Terms and Conditions
1. The hotel does not permit: a) Clients to hammer nails, scotch tapes, pins to put up posters or banners on the walls, panel or doors of Banquet Hall. b) Locking/ blocking of fire exit doors with equipment. c) Carpentry/Masonry/Civil or other engineering related jobs. d) Moving of heavy equipment in the function room without proper protection of the floors /carpet. e) Tampering or removal of hotels electrical and power installation. f) Cutting & Trimming hotel’s existing trees or plants g) Security deposit of INR 5000/- need to deposit for the exhibition set-up before the event which is totally refundable. In case any damage occurs to the property during the set-up, then the hotel will be deducting the cost of damage from security deposit. 2. All Display material within the banquet area requires the approval of the Hotel Management. 3. The hotel does not permit welcome Signage or banner display in the lobby, driveway or any other part of the hotel premises except inside banquet venue. 4. For any banners or signboards, kindly submit to the Hotel a sample of the visuals. The Hotel can refuse any banners, backdrop or signage that are brought in without prior approval with the Hotel or that the items do not confirm with the regular standard of the hotel. 5. All Promotional Material/Banners including Backdrop should be on self-standing Display Boards 6. The client is responsible for directing their contractors to observe the Hotel’s Guidelines and as such the client is responsible for any damage caused by the guest or the contractor to the hotel premises. 7. The people involved in the movement of goods and erecting the set up for the event from the clients end need to maintain discipline in the hotel premises. They need to be in Neat and clean / proper uniforms. Their movement is confined to the function venue. 8. For all functions with special electric requirement e.g. heavy electric load or uninterrupted power supply, the hotel must be intimated by the organizers at the time of confirmation or at least 7 days in advance to plan for the same. Any cost incurred in this process will be charged to the guests / organizers. 9. Set ups involving noisy activities like hammering / banging loud cutting etc. will be planned in consultation with the Hotel and no such activity will be allowed without prior permission. 10. The hotel does not provide any storage facility for goods / materials / equipment brought from outside the hotel, other than the venue reserved for the function on the said date and time. The Client must remove and take back his belongings/goods/materials immediately after the function is over. The hotel will not be responsible and will not accept any liability for and loss, damage or malfunction of the merchandise/ belongings/ materials or equipment left prior to, during or after its removal from the hotel. 11. The Client has agreed to ensure that goods/materials shall be brought inside the Hotel from the hotel service gate under supervision of security with valid gate pass authenticated/issued by Hotel Security. 12. The Client has agreed that any use of the Hotel logo and/or its name together with the artwork in advertising shall be approved in writing together with the artwork by the Hotel management and approval shall be obtained by the Client prior to its use. It is further agreed by the Client that the Client shall notify the Hotel prior to any photography or recording, which may cause disruption to the Hotel. 13. It is agreed by the Client that during event/function the client or its agents shall not make use of any Inflammable material, harmful Chemicals/Biological agents, Confetti, Gas filled balloons inside the hotel premises. 14. It is agreed that the Client or his agent will communicate with the Banquet Manager of the Hotel for smooth and successful conduct of the event/function. 15. The Client shall not violate any of the prevailing local laws, customs and avoid any performance or act, which may hurt the sentiments of the any community in general or which is contrary to the nature of Hotel business. 16. The Client shall assist the hotel security personnel in identification of guests to avoid trespassers and uninvited elements in the event/function. 17. The Client or its agents shall obtain NOC from Visakhapatnam Traffic Police in respect of LCV/HCV deployed for transportation of goods, material, and equipment to the Hotel premises. 18. The management of the Hotel is not liable for any loss or damage to client and his guests’ during the event. 19. The hotel has covered vehicle parking subject to availability at no charge. In case of client foreseeing additional requirement, the hotel will provide necessary assistance provided intimation is given upon confirmation of function. 20. The hotel reserves the right to re allocate any function to an alternative function room should this be unavoidably necessary. If final numbers increase or decrease significantly from those advised at the time of booking, we may substitute a more appropriate room of our choice. We will discuss any such changes with you prior to such change. 21. The Hotel reserves the right to decline any event or function that contradicts prevailing local laws or is contrary to its nature of business. 22. The Client is responsible for the protection of all Hotel surfaces in the case of outside props or equipment brought into the Hotel by them or its authorized persons. Any damage to the Hotel surfaces due to disregard of Hotel policy in this matter, will be at the cost of the client. The client is liable for any damage caused to the property or equipment of the Hotel by the Client’s guests attending the Event or by the event management company employed by the Client. 23. All AV & Electrical installation provided by the Client or the Hotel will be supervised by the Hotel’s Engineering Department. The Client is required to conform to any recommendations made by Hotel’s management in this regard. 24. Where additional sound, lighting or electrical installations may be necessary for a function, either by the hotel or by a sub-contractor, then the hotel reserves the right to levy an additional charge at its discretion for such work and it should comply with the hotel safety standards. 25. Apart from the approved parties/agencies of the hotel no other party/agency will be permitted to undertake arrangements for stage and dance floor, Audio Visual equipment, floral decorations within the hotel premises.
